Legal Update

The New Regulatory Scenario

Following the most recent legislative interventions, the landscape for obtaining Italian citizenship by descent (iure sanguinis) has changed deeply.

The new regulations have significantly reduced the possibility of taking legal action for more remote lineages. However, there is still ample room for action.

The judicial route remains the most solid solution for those with a direct link to Italy: the right is fully protected for all first or second-degree descendants (parents or grandparents) born in Italy and holding Italian citizenship. Our Law Firm deals exclusively with this route, guaranteeing a specialized technical defense before the competent courts throughout the national territory.

Appeals Channels

Our Judicial Routes

We identify the optimal procedural strategy for your specific family lineage branch.

1. Maternal Descent (1948 Cases)

We protect the descendants of Italian women born before 1948 who, under the discriminatory regulations in force at the time, could not pass on citizenship to their children. Today, case law recognizes the possibility of overcoming this injustice through legal action.

Requirements The petitioner, claiming maternal descent passed on before 1948, must still be a first or second-degree descendant.
Required Documents Those proving the line of descent: birth, marriage, and death certificates of the Italian ancestor (female or male line) and a certificate of non-naturalization, plus the same documents for all descendants down to the petitioners.

2. Paternal or Grandfather Descent

We assist descendants of Italian citizens who wish to obtain Italian citizenship iure sanguinis by proving descent from an Italian father or grandfather who emigrated abroad, in compliance with the requirements provided by Italian law (the new Tajani Decree).

Requirements Having a first or second-degree ascendant (father/mother or grandfather/grandmother) who is an Italian citizen born in Italy.
Required Documents Those proving the line of descent, namely the birth, marriage, and death certificates of the Italian ancestor (female or male line) and a certificate of non-naturalization, plus the same documents for all descendants down to the petitioners.

3. Against "Consular Queues"

Outside of the cases listed above (and therefore also for those with more distant lineages), it is still possible to appeal to the Italian courts if it can be proven that an attempt was made to contact the Italian Consulates before March 28, 2025 (proof must be provided via email or other means).

Requirements Having attempted to contact the consulates without receiving any response.
Required Documents Those proving the line of descent, namely the birth, marriage, and death certificates of the Italian ancestor (female or male line) and a certificate of non-naturalization, plus the same documents for all descendants down to the petitioners, as well as documentation proving the attempts made to book an appointment at the consulates.
Practical Instructions

The Required Documentation

The correct preparation of foreign documents is the key to passing the rigorous scrutiny of Italian judges.

A

The Italian Ancestor (Avo)

It is essential to retrieve and present the complete birth, marriage, and death certificates of the founding ancestor born in Italy.

B

Line of Descent

Birth and marriage certificates of all descendants must be presented, starting from the ancestor down to the petitioners, proving the unbroken chain of bloodline.

C

Certificate of Non-Naturalization

This certificate proves unequivocally that the emigrated ancestor did not renounce Italian citizenship (meaning they did not naturalize as a US citizen) before the birth of the direct descendant.

Note on Filiation

If a marriage certificate is missing in your genealogical chain, it is not an insurmountable problem. Our Law Firm's legal experience allows us to legally prove filiation in court through other solid documentary evidence accepted by Italian courts.

Professionalism and Rigor

Translations and Certified Legalization (Asseverazione) in Italy

Documents issued in the United States must be correctly translated to have legal value before an Italian Judge. Do not rely on simple translations done abroad: they could be rejected.

Legal Translation

Documents produced in the USA must be accurately translated. Avoid generic translations done abroad: our professional legal translators guarantee rigorous standards suitable for the Italian judicial authorities.

Asseverazione & Court Oath

We directly handle the swearing of translations at the Clerk's Office of the competent Italian Court. This key step transforms translations into public deeds with legal validity.

Document Retrieval in Italy

If some birth or marriage certificates of your ancestors are located in Italy, our firm will retrieve them directly from the competent Municipalities (Comuni) to speed up your process.

Clear Agreement

Cost Transparency

We believe in a relationship of trust founded on maximum economic transparency from the first day of legal assistance.

State Fee
€ 600.00
Court Filing Fee (Contributo Unificato)

Fixed state tax due to the Italian government for court and judicial costs for each petitioner.

Legal Fees & Retainers

Our professional fees for analyzing the case, drafting the appeal, active defense, and representation before the Court are formulated in a clear, detailed, and final quote.

The customized quote is calculated only after a preliminary review of your family tree and the complexity of your genealogical documentation.

Frequently Asked Questions (FAQ)

Immediate answers from the Firm to the most common questions regarding judicial appeals.

Yes, it is possible and highly advisable to include your children in the same proceeding. Although case law is not yet uniformly established in every court in Italy, the current trend and the majority of courts have opened up this possibility with excellent results, allowing the entire family unit to obtain citizenship through a single legal action.
The timeframe depends exclusively and strictly on the workload of the specific competent Court (determined by the birth town of the emigrated Italian ancestor). However, our Law Firm ensures timely drafting and filings to minimize any bureaucratic wait times as much as possible.
Certainly. Our Law Firm has a consolidated national operating capacity, enabling us to file, represent, and follow judicial appeals before any civil Italian court with territorial jurisdiction.
